Agreement to Terms

By accessing or using the website or services of Fortunate1 Automations | FORTUNATE1 LLC ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, you should not use our website or services.

 

Description of Services

Fortunate1 Automations provides AI-powered marketing and communication automation services for service-based businesses. These services may include:

      AI voice agents

      Website chat widgets

      Smart website development

      Lead capture and follow-up automation

      Appointment scheduling systems

      CRM setup and workflow automation

      Marketing communication tools

 

We use the GoHighLevel platform to manage customer relationships, communication workflows, forms, scheduling, email messaging, phone calls, voicemail delivery, and SMS communications. Service scope, pricing, and deliverables are confirmed during the onboarding process.

 

Eligibility

You must be at least 18 years old and legally able to enter into binding agreements to use our services or opt in to receive communications.

 

User Responsibilities

You agree to provide accurate information when interacting with our website, forms, or services. You are responsible for maintaining the confidentiality of your login credentials where applicable.

 

Acceptable Use

You agree not to:

      Use our services for unlawful purposes

      Attempt to disrupt or interfere with system functionality

      Attempt unauthorized access to systems or data

      Provide misleading or fraudulent information

 

Payments and Billing

Service Fees

Service pricing is agreed upon prior to project initiation and confirmed in writing. By agreeing to our services, you authorize Fortunate1 Automations to invoice you for the agreed service fees.

 

Invoice Terms

Invoices are issued monthly or as otherwise agreed. Payment is due within 7 days of invoice date unless otherwise stated in writing.

 

Late Payments

Failure to make timely payment may result in service suspension. Services will be reinstated upon receipt of outstanding payment. Fortunate1 Automations reserves the right to charge a late fee of 1.5% per month on outstanding balances.

 

Cancellation

Either party may cancel services with 30 days written notice. Fees incurred up to the cancellation date remain due and payable. Setup fees and completed work are non-refundable.

 

Refund Policy

Monthly service fees are non-refundable once the billing period has begun. Refunds will not be issued for partial months. In cases where Fortunate1 Automations fails to deliver agreed services, refunds will be considered on a case-by-case basis at our sole discretion.

 

Intellectual Property

All website content, branding, automation systems, designs, and service materials remain the intellectual property of Fortunate1 Automations unless otherwise stated in writing. Custom-built systems and workflows created specifically for a client remain the property of Fortunate1 Automations unless a separate written work-for-hire agreement is in place.

 

Disclaimers

Services are provided on an "as-is" and "as-available" basis. We do not guarantee specific marketing performance, lead volume, sales conversions, or revenue results. AI voice agent and automation performance may vary based on call volume, client configuration, and external factors outside our control.

 

Limitation of Liability

To the maximum extent permitted by law, Fortunate1 Automations shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability shall not exceed the total fees paid by you in the 3 months preceding the event giving rise to the claim.

 

Indemnification

You agree to indemnify and hold harmless Fortunate1 Automations, its owners, employees, and contractors from any claims, damages, or expenses resulting from misuse of services or violation of these Terms.

 

SMS Messaging Terms

Fortunate1 Automations provides AI marketing automation and communication systems for businesses. When you opt in to receive messages from us, you may receive appointment reminders, onboarding notifications, service updates, customer support messages, and occasional promotional communications related to our automation services.

 

You can cancel the SMS service at any time. Just text "STOP" to (708) 847-0078. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

 

Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

White-Label Platform Services

Fortunate1 Automations provides clients with access to a white-labeled automation platform built on GoHighLevel technology. By using our automation services you acknowledge the following:

 

      The platform is powered by GoHighLevel Inc., a third-party software provider. Fortunate1 Automations operates as an agency and provides this technology under our brand.

      Fortunate1 Automations is not liable for any GoHighLevel platform outages, data loss, feature changes, security breaches, or service interruptions. These are outside our direct control and governed by GoHighLevel's own terms of service.

      Client sub-accounts created within our platform remain under the management of Fortunate1 Automations unless otherwise agreed in writing. Clients may request export of their contact data at any time.

      Fortunate1 Automations reserves the right to adjust, update, or migrate platform tools as GoHighLevel releases updates. We will communicate material changes to clients in advance where possible.

 

HIPAA — Healthcare Clients

For clients who are healthcare providers or covered entities under HIPAA (including chiropractic offices, medical practices, dental offices, and similar), the following additional terms apply:

 

      A signed Business Associate Agreement (BAA) is required before Fortunate1 Automations may begin processing any patient information on the client's behalf.

      The client is responsible for ensuring their use of our services complies with all applicable HIPAA requirements.

      Any patient information processed through our AI voice agent or automation systems will be treated as Protected Health Information (PHI) and handled accordingly.

      Fortunate1 Automations will maintain HIPAA-compliant infrastructure for healthcare client sub-accounts, including use of GoHighLevel's HIPAA-compliant plan.

      In the event of a data breach involving PHI, Fortunate1 Automations will notify the client within 60 days of discovery as required by the BAA.

 

Third-Party Platforms

Our services integrate with trusted third-party providers including GoHighLevel, telecommunications carriers, messaging platforms, and payment processors. We are not responsible for the performance or policies of these external systems.

 

Termination

We reserve the right to suspend or terminate access to services at our discretion if these Terms are violated. Upon termination, all outstanding invoices become immediately due and payable.

 

Governing Law

These Terms are governed by the laws of the State of Illinois.

 

Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If not resolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association in Illinois.

 

Changes to Terms

We may update these Terms from time to time. Continued use of our services after updates constitutes acceptance of the revised Terms.
